Terms of Use

We custom-make ALL orders as they are received. ALL sales are final. Due to shipping / receiving delays from some of our vendors, there may be a time that an order will NOT ship immediately. Please understand that we cannot control our vendors. We try to keep all outside products in stock; however, sometimes there are delays due to inventory / manufacturing. This may cause a delay in shipping that is not of our fault.

Privacy Policy

This site may contain other proprietary notices and copyright information, the terms of which must be observed and followed. Information on this site may contain technical inaccuracies or typographical errors. Information, including product pricing and availability, may be changed or updated without notice. LemonadeSource.com reserves the right to refuse service, terminate accounts, and / or cancel orders in its discretion, including, without limitation, if LemonadeSource.com believes that customer conduct violates applicable law or is harmful to the interests of LemonadeSource.com.

Shipping and Delivery

LemonadeSource.com ships merchandise to 48 locations within the United States and U.S. territories. HOWEVER; THE CUSTOMER IS RESPONSIBLE FOR ALL CUSTOMS AND SHIPPING CHARGES. The risk of loss and title for all merchandise ordered on this website passes to you (the customer) when the merchandise is confirmed delivered by the shipping carrier to the address you provided.

Sales Tax

LemonadeSource.com does not charge sales tax for all merchandise ordered except within the State of North Carolina.

Online Payment Processing Fee

We use GoDaddy Payment Systems which charges a fee of  2.9% + $.0.30 per transaction. The processing and transaction fees will be passed along to the buyer.

Warranties - All Equipment

All equipment sold by LemonadeSource.com is sold AS IS and WITHOUT WARRANTY, unless a specific written warranty is expressly provided by LemonadeSource.com for a particular product.

To the fullest extent permitted by applicable law, LemonadeSource.com disclaims all express and implied warranties relating to its equipment and products, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Unless expressly stated otherwise in writing by LemonadeSource.com, no warranty is provided for parts, labor, repair, replacement, service, technical support, loss of use, lost income, lost profits, business interruption, or other incidental or consequential losses.

Certain components may be considered wearable, replaceable, consumable, or service parts. Their service life may vary depending on frequency of use, operating conditions, product size or hardness, operator technique, cleaning, maintenance, storage, transportation, misuse, abuse, alteration, or other conditions outside the control of LemonadeSource.com. Such parts are not covered by warranty unless expressly stated otherwise in writing.

Replacement parts may be available for purchase when available. LemonadeSource.com does not guarantee the continued availability of any replacement part and is not obligated to manufacture, stock, reproduce, or continue offering replacement parts for any equipment or product, including equipment or products that have been modified, redesigned, superseded, or discontinued.

The use of aftermarket parts, unauthorized replacement parts, third-party accessories, modifications, alterations, or repairs not approved by LemonadeSource.com may make the equipment ineligible for technical support, repair assistance, service consideration, or other assistance from LemonadeSource.com.

Normal wear and tear, cosmetic imperfections, scratches, scuffs, weld discoloration, heat tint, surface marks, minor variations in finish, minor flexing, bending, or other conditions that do not materially affect the intended operation of the equipment are not considered manufacturing defects.

LemonadeSource.com is not responsible for damage or failure resulting from improper use, misuse, abuse, overloading, improper cleaning, improper maintenance, improper storage, improper transportation, use outside the intended application, use with materials or products outside recommended specifications, unauthorized modification, or failure to follow operating instructions.

No employee, contractor, representative, reseller, distributor, agent, or other person is authorized to create, modify, extend, or provide any warranty on behalf of LemonadeSource.com unless the warranty is expressly provided in writing by LemonadeSource.com.

Any description, photograph, illustration, specification, performance statement, demonstration, video, advertisement, or other product information is provided for general informational purposes and does not create a warranty unless LemonadeSource.com expressly identifies it in writing as a warranty.

Nothing in these Terms and Conditions is intended to exclude or limit any right, remedy, or obligation that cannot legally be excluded or limited under applicable law.

Returns

Customer may purchase merchandise from this website.  LemonadeSource.com reserves the right to change its payment procedures at any time without prior notice to you. All orders are final and no returns are allowed. Any cancellation of order(s) or allowed returns must be approved by LemonadeSource.com and are subject to a restocking fee of 30% of the equipment purchase price. There are no exceptions with regard to any return of the Lemon Rocket as it is a fully made-to-order custom machine. 

Customer Disputes

Customer agrees to handle any disputes with LemonadeSource.com directly without involving any third party.

No Chargebacks

By using our website to order a product, you agree that you will not initiate or threaten to initiate any chargebacks to LemonadeSource.com or any payment method (e.g., credit / debit card, Stripe, PayPal) for any reason related to the services and / or products provided by LemonadeSource.com, as long as LemonadeSource.com delivers the promised service / product to the shipping address you provided on the original order. Proof of Delivery is confirmation from the shipper that the product was delivered. You understand that any such chargebacks will be considered a breach of this agreement.

Non-Disparagement

Customer agrees that if any issues arise with any product that they will refrain from posting anything on any social media forum and contact LemonadeSource.com to discuss resolution. Customer agrees that posting anything negative about LemonadeSource.com on any social media forum would cause irreparable harm to LemomadeSource.com and the Customer may be held liable. 

Design / Components Used in Construction 

The design of our equipment, and the components used in their constructio, may vary from time to time depending on parts availability. These changes can occur without any notification via the website and / or other communication but wil be of equal or better quality. We use stainless steel and / or aluminum in the construction of our products. Some products are powder-coated in colors. Powder coating can fade, chip or peel over time when exposed to sunlight and / or acidic fruits and especially when not cleaned properly after use. LemonadeSource.com makes no warranties on any powder-coated surfaces.

VOID WHERE PROHIBITED: 

Although the information on this website is accessible worldwide, not all products or services discussed in this website are available to all persons or in all geographic locations or jurisdictions. 

LemonadeSource.com and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of LemonadeSource.com shall apply and both parties shall consent to the jurisdiction of said State's courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between customer and LemonadeSource.com with respect to this website

Safety Disclaimer

Any air-powered or manually operated equipment can be dangerous and could cause serious injury if not operated properly. We do not recommend operation of equipment by a minor without adult supervision. Customer assumes ALL RISKS associated with operation of any equipment sold by LemonadeSource.com and agrees to hold LemonadeSource.com harmless from the date of receipt of their purchase.
